株式会社アップシーエム（以下「当社」といいます）のプライバシーポリシー（以下「本ポリシー」といいます）では、当社が提供するモバイルアプリケーションを含むあらゆるアプリケーション及びWebサービス（以下「本サービス」と総称します）に関して情報を収集、利用、共有、および保護する方法と、利用者が自身の情報の収集および利用について選択できる内容について説明します。
本サービスを利用することにより、利用者は、写真、コメントなどの素材を含む各種コンテンツ（以下「ユーザーコンテンツ」といいます）を本サービスに投稿して共有・公開するためのプラットフォームを当社が提供していることを理解し、これに同意します。これは、利用者が本サービスを通じて公開したユーザーコンテンツを、他のユーザーは本ポリシーおよび当社利用規約の規定により検索、閲覧、利用、共有できることを意味します。
本ポリシーは、本サービスを利用するすべてのビジター、ユーザー、その他の利用者（以下「ユーザー」といいます）に適用されます。

当社が収集する情報

本ポリシーにおいて、「利用者情報」とは、ユーザーの識別に係る情報、通信サービス上の行動履歴、その他本サービスに関連し生成または蓄積された情報であって、本ポリシーに基づき当社が収集する情報を意味し、「個人情報」とは、個人情報保護法第2条第1項に定める「個人情報」を意味するものとします。
本サービスにおいて当社が収集する利用者情報には、以下の情報を含みます。

（１）ユーザーからご提供いただく場合のある情報
① メールアドレス、電話番号
② ユーザーネーム、パスワード、プロフィール情報（姓名、プロフィール写真等）
③ ユーザーコンテンツ（写真、コメント、質問、回答、選択肢、リアクション、評価、その他の素材等）
④ ユーザーと当社との間の通信内容（サポート依頼、お問い合わせ内容等）

（２）ユーザーが本サービスを利用する際に自動的に収集される場合のある情報
① サービス利用データ（回答内容、選択内容、正誤情報、閲覧・クリック・シェア・スキップ・保存・再生成・通報等の利用行動、滞在時間、流入元、エンゲージメントシグナル、その他本サービス上でのインタラクションデータ）
② クッキー（Cookie）及び類似の技術を通じて収集される情報
③ ログファイル情報（IPアドレス、ブラウザの種類、参照/終了ページ、URL、クリック数、ドメイン名、ランディングページ、閲覧したページ等の情報）
④ デバイス識別子（本サービスにアクセスするために使用されるデバイスの識別情報、OS、ハードウェアモデル等）

利用者情報の利用目的

当社は、収集した利用者情報を、以下の目的（以下「利用目的」といいます）に必要な範囲で利用します。

（１）本サービスの提供、維持、保護、改善、研究開発、品質向上のため
（２）本サービスに関するご案内、お問い合わせ等への対応のため
（３）本サービスに関する当社の規約、ポリシー等に違反する行為への対応及び不正アクセスの防止・対応のため
（４）本サービスの利用状況の統計分析、マーケティング、レコメンド、診断のため
（５）本サービス内での質問生成、コンテンツ生成、及び適切な広告・コンテンツの配信のため
（６）機械学習モデル、人工知能（AI）モデル、アルゴリズム、アナリティクス、その他技術の開発、評価、検証、及び改善のため（当社の保有するAIモデルの学習、評価、チューニング、精度の検証、及び第三者のAI技術・モデル・商品・サービスの開発・評価・検証・改善への協力を含みます）
（７）個人を識別できない形式に加工した情報、統計情報、集計情報、分析情報、匿名加工情報（以下「統計情報等」といいます）の作成、及び第三者への提供・開示・販売・ライセンスのため

統計情報等の作成及び第三者への提供・販売・ライセンス

（１）当社は、ユーザーコンテンツ、サービス利用データ、その他収集した情報から、個人を識別できない形式に加工した情報や統計情報等を作成することがあります。当社は、これらの統計情報等について、当社の裁量により、研究機関、企業、広告主、調査会社、分析事業者、人工知能・機械学習モデルの開発・評価・改善を行う事業者その他の第三者に対し、提供、開示、販売、ライセンス、共同利用、処理委託またはその他の方法により利用させることができるものとし、ユーザーはこれに予め同意するものとします。
（２）当社は、統計情報等の作成および第三者への提供にあたり、法令および本ポリシーに従い、個人を識別できる情報の除去、マスキング、集計、匿名化、自由記述欄に含まれる可能性のある個人情報の検出・除外その他当社が適切と判断する措置を講じます。
（３）ユーザーがユーザーコンテンツを削除し、またはアカウントを削除・退会した場合であっても、当社は、法令上認められる範囲で、当該削除または退会前に取得、保存、分析、加工、集計、統計化、匿名化その他の処理を行った情報、統計情報等、バックアップ、ログ、派生情報、および第三者に既に提供済みの統計情報等について、引き続き利用、保存、提供、販売、ライセンスその他必要な取扱いを行うことがあります。この場合、当社は、法令上必要な場合を除き、既に作成済みまたは第三者に提供済みの統計情報等について、削除、利用停止、提供停止その他の措置を講じる義務を負わない場合があります。
（４）当社が個人情報保護法上の匿名加工情報を作成または第三者に提供する場合、当社は、同法その他適用法令に従い、必要な加工、公表、提供先への明示、安全管理その他必要な措置を講じるものとします。

情報の共有と開示

当社は、ユーザーの同意を得た場合、または法令により認められる場合を除き、ユーザーの個人情報を第三者に提供または共有しません。ただし、以下の場合を除きます。

（１）ユーザーの指示または同意に基づく共有（ユーザーが自ら本サービス上で公開したユーザーコンテンツの他のユーザーへの公開等）
（２）当社の業務委託先（サーバー運営会社、データ処理業者、カスタマーサポート提供業者等）への委託に必要な範囲での開示（この場合、委託先に対する適切な監督を行います）
（３）合併、会社分割、事業譲渡その他の事由による事業の承継に伴って個人情報が提供される場合
（４）裁判所、警察、その他の行政機関・公的機関からの法令に基づく要請に対応する場合
（５）当社、ユーザー、または第三者の権利、財産、安全を保護するために必要であると当社が合理的に判断した場合

データの保存とセキュリティ

当社は、収集した情報の紛失、悪用、改ざん、および不正アクセスを防止するため、合理的な技術的・組織的安全管理措置を講じます。ただし、インターネット上の通信や電子的保存の方法は100%安全ではないため、完全なセキュリティを保証することはできません。ユーザーは自らもアカウント情報等の適切な管理を行うものとします。

ユーザーの権利

ユーザーは、適用される法令に基づき、当社が保有する自身の個人情報について、開示、訂正、削除、利用停止、または消去を請求する権利を有する場合があります。これらの請求、その他個人情報の取扱いに関するお問い合わせは、末尾に記載のお問い合わせ窓口（info@app-cm.co.jp）までご連絡ください。当社は、法令に従い、合理的な範囲で速やかに対応いたします。

国際的な利用について

日本国外から本サービスにアクセスされる場合、ユーザーの情報は、ユーザーの居住国とはデータ保護法が異なる可能性のある国（日本を含みます）に転送され、処理されることがあります。ユーザーは、本サービスの利用により、情報の日本等への転送および処理に同意したものとみなされます。

本ポリシーの変更

当社は、自らの裁量により本ポリシーを随時更新または改定することがあります。本ポリシーを変更した場合は、本サービス内または当社ウェブサイト上の適切な場所への掲載その他当社が適当と判断する方法により通知し、本ポリシーの末尾に記載の改定日（発効日）を更新します。変更後の本ポリシーは、掲載された時点または明記された効力発生時期から有効となり、変更後にユーザーが本サービスを利用した場合は、変更後のポリシーに同意したものとみなされます。

準拠法、裁判管轄

本ポリシーの解釈にあたっては、日本法を準拠法とします。本サービスまたは本ポリシーに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を専属的合意管轄とします。

• 1. Information We Collect
We collect the following types of information:

(1) Information you may provide us directly:
• Your email address and phone number.
• Your username, password, and profile information (e.g., first and last name, profile picture).
• User Content (e.g., photos, comments, questions, answers, answer choices, reactions, ratings, and other materials) that you post, input, transmit, create, display, or store through the Services.
• Communications between you and App-CM Inc. (e.g., support requests, inquiries).

(2) Information automatically collected when you use the Services:
• Service Data: usage and interaction data generated through your use of the Services, including answers, selections, correctness labels, views, clicks, shares, skips, saves, regenerations, reports, time spent, referral sources, and engagement signals.
• Analytics, Cookies, and similar technologies.
• Log file information (IP address, browser type, referring/exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information).
• Device identifiers (unique identifiers for the device you use to access the Services, operating system, hardware model, etc.).


• 2. How We Use Your Information
In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:
• Provide, maintain, protect, improve, test, and monitor the effectiveness of our Services.
• Develop, evaluate, validate, and improve machine learning models, artificial intelligence (AI) models, algorithms, analytics, recommendation systems, and other technologies, products, or services of App-CM Inc. or third parties.
• Create, generate, or optimize content, diagnoses, recommendations, or questions within the Services.
• Respond to your inquiries, comments, or support requests.
• Monitor metrics such as total number of visitors, traffic, and demographic patterns.
• Diagnose or fix technology problems, and prevent fraud, abuse, or unauthorized access.
• Automatically update the App-CM application on your device.


• 2A. Information Processing and AI Training
You agree that we may process, analyze, classify, aggregate, de-identify, or anonymize User Content and Service Data to train, fine-tune, evaluate, test, and improve our artificial intelligence models, machine learning systems, and related automated technologies. To the extent permitted by applicable law, we may also share, sell, or license aggregated, statistical, analytical, de-identified, anonymized, or otherwise non-identifying information derived from User Content and Service Data to research organizations, companies, advertisers, analytics providers, AI developers, and other third parties for their own development, evaluation, testing, improvement, or commercial purposes.

Your deletion of User Content or termination of your account will not require us to delete, withdraw, or stop using aggregated, statistical, de-identified, anonymized, or otherwise non-identifying information that has already been created, used, provided, sold, licensed, or shared, except where required by applicable law.


• 3. Sharing of Your Information
We will not rent or sell your personal information to third parties outside App-CM Inc. without your consent, except as noted in this Policy.

Parties with whom we may share your personal information:
• Service Providers: We may share your information with third-party organizations that help us provide the Services to you (e.g., server hosting providers, data processing vendors, customer support providers). Our service providers will be given access to your information as is reasonably necessary to provide the service under reasonable confidentiality terms.
• Change of Control: If we sell or otherwise transfer part or the whole of App-CM Inc. or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name, email address, User Content and any other information collected through the Service may be among the items sold or transferred.
• Instances where we are required to share your information: We will disclose your information where required to do so by law or subpoena, or if we reasonably believe that such action is necessary to comply with the lawful request of a government or law enforcement agency, to enforce our Terms of Service, or to protect the security, rights, or safety of App-CM Inc., our Users, or others.

Parties with whom we may share non-personal information:
• We may share, disclose, sell, or license non-personal information, including aggregated, statistical, analytical, de-identified, anonymized, or otherwise non-identifying information, with third parties as described in Section 2A.
